Fair Labor Standards Act Regulatory Changes Put on Hold

On Tuesday, Nov. 23, a U.S. District Court judge issued a nationwide, preliminary injunction barring the U.S. Department of Labor from implementing and enforcing the revised Fair Labor Standards Act regulation that would change the salary threshold for overtime eligibility from $23,660 to $47,476. As a result of the injunction, the Department of Labor's revised regulatory changes that were scheduled to take place on Thursday, Dec. 1, have been halted. The Department of Labor is expected to appeal this case; however, the injunction is likely to be in effect throughout this legal challenge. 

In accordance with the court's ruling, the University of Arkansas will not change the FLSA exemption status for employees who have been previously classified as exempt (based on the current salary threshold test of $23,660 and related job duties test) to a non-exempt status.  These employees will remain exempt from overtime eligibility until further notice. The university will continue to monitor this injunction and will update the campus if circumstances change.
